FiatKey Terms of Use
These terms govern your access to the FiatKey digital asset exchange preview site (the “Platform”). Please read them carefully before interacting with the demo.
1. Service overview
FiatKey provides a non-transactional preview environment that illustrates anticipated fiat-to-digital-asset exchange journeys, operational dashboards, and compliance touchpoints. The Platform does not currently perform order routing, custody, payment settlement, or regulatory onboarding; those services will only be available through licensed partners once the production environment launches. Output displayed on the Platform— including quotes, routing suggestions, or performance metrics— is simulated and intended solely to help business users evaluate future workflows.
2. Eligibility & representations
By accessing the Platform you confirm that you are at least 18 years old, have the authority to act on behalf of your organization (if applicable), and are not subject to any sanctions or prohibitions that would restrict your ability to explore digital asset services. You further represent that any feedback or data you share is accurate and does not infringe the rights of third parties.
3. Permitted use & restrictions
FiatKey grants you a limited, revocable license to access the Platform for internal evaluation, user-testing, and integration planning. You agree not to:
- Reverse engineer, decompile, or otherwise attempt to derive source code.
- Bypass security controls, run automated scans, or introduce malware.
- Scrape, export, or commercialize interface assets without prior consent.
- Use the Platform to advertise, endorse, or facilitate real-money transactions, token launches, or securities offerings.
FiatKey may monitor usage to maintain platform integrity and may suspend access when suspicious activity is detected.
4. Market & technology risks
Digital asset markets are volatile and subject to regulatory change. Simulated prices, liquidity, or settlement timelines shown in the preview environment may vary materially from real-world execution once live services are available. Technology components can fail or become unavailable without notice. You acknowledge these risks and agree that FiatKey is not responsible for losses tied to your reliance on preview information.
5. Third-party services
The Platform may reference upcoming integrations with custodians, payment processors, or liquidity venues. These entities operate under their own contracts and compliance programs. FiatKey does not control third-party content, uptime, or due diligence outcomes and is not liable for their acts or omissions. Entering into binding agreements with such partners remains your responsibility.
6. Liability & indemnity
The Platform is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, FiatKey and its affiliates will not be liable for lost profits, loss of data, business interruption, or any indirect or consequential damages arising from or related to the Platform.
You agree to indemnify and hold harmless FiatKey, its directors, employees, and partners from claims arising out of your misuse of the Platform, violation of these terms, or infringement of third-party rights, except to the extent caused by FiatKey’s gross negligence or willful misconduct.
7. Intellectual property
All software, design systems, trademarks, and documentation are owned by FiatKey or its licensors. Feedback, configuration suggestions, or bug reports that you submit may be used by FiatKey without obligation, and you grant FiatKey a perpetual, royalty-free license to incorporate such input into future releases.
8. Compliance & sanctions
FiatKey reserves the right to request additional information to verify compliance with anti-money-laundering, counter-terrorist financing, tax reporting, and sanctions requirements. Access may be restricted for users located in embargoed jurisdictions or on restricted lists maintained by the United Nations, OFAC, the EU, or similar authorities.
9. Suspension & termination
FiatKey may suspend or terminate Platform access at any time, with or without notice, if it determines that continued access poses security, compliance, or commercial risk. Sections that by their nature should survive termination— including liability, indemnity, IP, and governing law— will continue to apply.
10. Governing law & updates
These terms are governed by the laws of the jurisdiction where the FiatKey operating entity is incorporated, excluding conflict-of-law rules. Disputes will first be addressed through good-faith negotiations; if unresolved within 30 days they shall be submitted to the competent courts of that jurisdiction. FiatKey may update these terms to reflect product changes or regulatory developments. Material updates will be noted on this page with a revised “last updated” date, and continued use constitutes acceptance of the revisions.
